Judge allows Florida RV park’s lawsuit against county to continue

(Oct. 20, 2009) — The Walton County Board denied the project based on an un-adopted standard made up by Walton County after receiving public opposition to the project. The county had argued that, as a matter of law, Jolly Bay was precluded from asserting federal due process and takings claims against the county. The denial of the county`s motion allows the lawsuit to move forward. If successful, the county, and its taxpayers, will have to pay Jolly Bay`s damages and attorneys` fees, which are well in excess of the county`s $1 million in insurance coverage.
