Fifth wheel buyer sues manufacturer, dealer

NEW ORLEANS, La. — A buyer is suing the manufacturer of a recreational vehicle and the dealer where the RV was purchased, citing alleged breach of the warranty contract.

Georgia resident Curtis D. Cagle filed a complaint on Oct. 19, in the U.S. District Court for the Eastern District of Louisiana against defendants Forest River and Dixie Motors, alleging that they violated the Magnuson-Moss Warranty Act, according to the Louisiana Record.

According to the complaint, the plaintiff purchased a new 2014 Prime Time Sanibel 3050 on Nov. 3, 2014. When delivered, the fifth wheel RV was defective in materials and workmanship, and the defects were discovered within the warranty periods, the Louisiana Record reported.

  1. Do these lawyers in Louisiana ever win?

Every one of these “lawsuits” are based in Louisiana……

  2. Louisiana has laws that actually work in the favor of the consumer. The manufacturer loses these cases many times. What I find odd is this consumer is a resident of Georgia where the lemon law only applies to motor vehicles and in the case of a MOTORHOME only the chassis side of things

  3. RV manufactures will never deliver a quality product until Asia country’s get in the RV business. i.e. like the auto manufacturers in North Ameeica!
